This agreement governs the General Terms and Conditions for the various services offered on this website www.emmapalacio.com and the commercial relationships Emma Llorente Palacio (website owner), and you as the user/customer. By accessing and using this website, you agree to comply with the terms outlined here. I recommend that you read this document carefully before making any purchases.

1. Acceptance of the Terms

By accessing or using this website and making a purchase, you fully accept these Terms and Conditions. If you disagree with any part of these terms, you must refrain from using my services.

2. Online Store Terms

By accepting these Terms of Service, you declare that you are at least the age of majority in your state or province of residence or that you are of legal age in your state or province of residence and have given your consent to allow any of your minor dependents to use this site. A violation of any of the terms and conditions in this agreement will result in the immediate termination of my services.

3. Purchase Process
To make a purchase on www.emmapalacio.com, you must follow the process outlined on the website:

  • Select the desired products and add them to the shopping cart.

  • Fill in the necessary billing and shipping information.

  • Select the desired payment method.

  • Confirm the order.

4. Prices and Payment Methods

The product prices are expressed in euros and include 21% VAT. I reserve the right to modify prices at any time, although products will be billed according to the price in effect at the time of placing the order. I accept the following payment methods:

  • Credit/debit card (Visa, MasterCard, etc.)

  • PayPal

If there are any issues with payment, I will contact you to resolve them.

This online store is hosted on Wix.com Ltd., which provides the online e-commerce platform that allows me to sell my products and services to you.

5. Modifications to the Service and Prices

The prices of my products are subject to change without notice. Access to this website and its content may be temporarily modified or suspended without notice due to system failures, necessary maintenance or repairs, or for reasons beyond my control.

 

6. Production Times

Production time may vary between 3 and 10 business days (Monday to Friday), depending on the workload. All items require long production times due to the delicate and specific process in which they are created. If your purchase is time sensitive, please contact me at contact@emmapalacio.com before making it to coordinate a suitable delivery date.

 

7. Shipping and Delivery
I offer standardized shipping within the European Union via UPS or DHL.

  • Standard shipping for Spain and Portugal: delivery times of 2 to 5 business days (Monday to Friday, excluding holidays).                  Shipping cost: 4.95 euros. Free shipping for purchases over 150 euros.

  • Standard shipping for the rest of the European Union: an estimated delivery date will be provided once the shipment has been dispatched.   Shipping cost: 9.95 euros. Free shipping for purchases over 300 euros.

I am not responsible for delays caused by the courier company.

If you are located outside the European Union and wish to make a purchase, please contact me at contact@emmapalacio.com so I can organize your order and shipping personally. Customers purchasing from non-EU countries may have to pay additional taxes, and the order must go through customs clearance. I am not responsible for costs or delays caused by customs.

8. Cancellations
You may only cancel an order on the same day of completing the purchase and before 5:00 p.m. local Spanish time. Cancellations can be made by sending an email to contact@emmapalacio.com.

 

9. Returns and Refunds Policy
You have the right to return products within 14 calendar days from the receipt of the order, provided the products are in perfect condition, unused, and in their original packaging. Returns do not apply to custom-made or personalized products.
To manage a return, you must contact me at contact@emmapalacio.com, indicating the order number and reasons for the return. Shipping costs for returns are the customer’s responsibility, except in cases of errors in the shipment by me. If the product arrives in a different condition than when received, the amount will not be refunded. This is especially important to me since I sell decorative pieces made of delicate materials that, if broken, cannot be repaired.
Refunds will be made using the same payment method used in the original purchase within 14 days of receiving the returned products.

 

10. Product Warranty
All ceramic items sold by www.emmapalacio.com are handmade in Barcelona, Spain. Each piece is unique and handmade in small batches, resulting in variations in shape and finish. Glaze variations may include, but are not limited to: small holes, glaze thickness, and small stains. Variations are not considered defects and will not be eligible for return or replacement.
The measurements provided in the product descriptions are approximate; there may be small millimeter variations between different pieces due to their artisanal production.

Stoneware and earthenware are semi-porous materials; sweat and condensation occur naturally and may leave water marks on surfaces. I am not responsible for marks left by the ceramics on surfaces. The products offered in my online store are subject to legal warranty according to applicable laws. If you receive a defective or damaged product, please contact me at contact@emmapalacio.com to arrange for replacement or repair.

 

11. Colors
I cannot guarantee that the colors on the website are completely equivalent to the actual colors of the items. This partly depends on the color settings of your computer and monitor. My pieces are handmade, which means that each particular item may differ slightly due to the clay and glazes, and may vary slightly from one production to another.

 

12. User Responsibilities and Restrictions
You agree to:

  • Provide truthful and up-to-date information during the registration and purchase process.

  • Not make fraudulent or illegal purchases.

  • Not use vulgar, threatening, or offensive language, including but not limited to defamatory, slanderous, racist, sexist, homophobic, or sexually explicit language.

  • Not use the website in any way that could encourage, facilitate, or conduct criminal activities.

  • Not distribute illegal material that infringes copyright, advertising, indecent, or offensive, or transfer files containing viruses, trojans, or other harmful programs; or use the website for any purpose other than personal use.

  • Not use this website for unlawful purposes or in a way that harms Emma Llorente Palacio.

I am not responsible for damages resulting from the improper use of products purchased on my website.

 

13. Errors and Inaccuracies
Although it is my priority to provide you with complete, up-to-date, and accurate information, my website may contain content subject to human and/or technological errors (e.g., typographical errors, inaccuracies, omissions, etc.). This content may include information related to prices and availability, as well as material that is incomplete or outdated. I reserve the right to correct such information, even after an order has been placed. I may change or update information without prior notice at any time. Therefore, I apologize for any inconvenience such errors may cause.

If any part of these General Terms and Conditions is illegal and therefore invalid, this will not affect other legal provisions, which will remain in this Terms and Conditions agreement.

All the content on this website, including texts, graphics, logos, icons, and images used, is the property of Emma Llorente Palacio or my content providers and is protected by intellectual property laws. The reproduction, distribution, or modification of any content is strictly prohibited without my express written consent.
